GUIDELINES FOR BUILD New Mexico &
UNION FINANCED PROJECTS
 
 

Dated December 9, 2002

The ultimate responsibility for complying with these guidelines falls on the General Contractor and subcontractors participating in a BUILD New Mexico project. If a General Contractor and Subcontractor chooses to participate in these union projects, that General Contractor and Subcontractor must be accountable to the program to assure that all guidelines below are met.

1. It is the understood intent of these projects to demonstrate to the community that our union industry can construct high quality projects with a sense of harmony between all parties. These include but are not limited to the Owner, Architect, General Contractor, Subcontractors and all Unions.

2. To qualify as a union General Contractor, you must be signatory to four (4) out of, the five (5) basic crafts (Carpenters, Cement Masons, Laborers, IronWorkers, Operators), for a minimum of the prior six (6) months.

3. To qualify as a union Subcontractor, you must be signatory to your primary craft and must have been so for a minimum of the prior 6 months and also paying at the minimum the New Mexico wage and fringe scale for the appropriate work scale for the appropriate work.

4. If a General Contractor or Subcontractor is not signatory to a specific craft, that in no way eliminates the requirement for using union craftsman on that scope of work.

5. When any General Contractor and Subcontractor of any tier perform work on these projects, aII BUILD New Mexico guidelines are applicable at all levels.

6. It is a requirement of the program that the General Contractor provide the program with a complete list of all Subcontractors including all Tier Subs. The Subcontractor list must identify scope of work at time of submitting list of all tier subcontractors for approval. No work will be performed until this list is both received and approved by the Board of Directors of BUILD New Mexico.

7. In the event that General Contractors or Subcontractors of any tier anticipate difficulty compiling with the mandatory use of signatory contractors or other BUILD New Mexico guidelines, written notification shall be made to the Executive Director of BUILD New Mexico immediately.

8. Any challenges to the list of contractors or subcontractors must submitted to the Executive Director of BUILD New Mexico in writing.

9. The BUILD New Mexico Board of Directors will be the final authority to approve the contractor/subcontractor list for each project after the list has been submitted to MCA, NECA , NMSMCA and NMBCTC for their review.

10. Guidelines will be reviewed and/or updated by the BNM Board of Directors periodically.
